Our Services
Your Key To Senior Living Options is a senior housing and care marketing and information service that provides resources and personalized assistance in finding senior housing and care. We help families find options based on a loved one’s stated needs and preferences and empower them to make informed decisions. This may include independent living, home care, residential care homes, assisted living, specialized memory care, and skilled nursing. Based on the family’s stated needs and preferences, we provide the family with information about contracted communities (“Participating Communities”), and we may disclose the family’s information to those Participating Communities. Families can review detailed information about Participating Communities, and get personalized, knowledgeable assistance by telephone, email, and in-person from a Senior Living Advisor. The service is offered at no charge to families as the Participating Communities pay a fee to Your Key To Senior Living Options.
All information, materials, content, or advice provided through the Service is for informational purposes only and is not intended to replace or substitute for any professional, financial, medical, legal, or other advice. You should consult with an appropriately trained specialist for all concerns that require medical, legal, financial, or other professional advice.
Participating Communities
The Participating Communities are solely responsible for evaluating, accepting (or declining, as appropriate), and caring for all residents, including, without limitation, ensuring that their staff is appropriately qualified, current on education, and possess the necessary facilities, resources, and equipment to competently provide the services and care required by its residents. Each Participating Community is responsible for the conditions at its community and the training of and acts and omissions of its employees, contractors, vendors, and any other individual who works at or for a community.
Each Participating Community is responsible for the content of the information posted on its page or linked on our Service. The information provided by the Participating Community does not represent our views or any individual associated with us, and we do not control this content. We do not vouch for the accuracy or completeness of any of the information posted by the Participating Community and do not take any responsibility or assume any liability for any actions you may take as a result of reading the information posted by or for the Participating Community on our Service.
The selection of a Participating Community is your decision. We provide options and information of facilities based on information provided by you to Your Key To Senior Living Options and do not register or place you in any Participating Community or participate in your decision regarding final selection or admittance. Further, it is the responsibility solely of the Participating Community and the potential resident (including the potential resident’s family, care provider(s), or other involved parties acting on the potential resident’s behalf) to determine if any person is an appropriate admission to the Participating Community. Your Key To Senior Living Options does not broker, sell or lease space with any Participating Community directly and is not a party to any transaction between the Participating Community and the family.
Ownership of Service
The Service and all of its content, including without limitation all copyrights, patents, trademarks, service marks, and trade names, as well as all logos, text, design, graphics, logos, icons, images, audio clips, downloads, interfaces, code and software, as well as the selection and arrangement thereof, and all other intellectual property (collectively referred to as the “Content”), are all proprietary and owned or controlled by Your Key To Senior Living Options, our licensors, and certain other third parties. All right, title, and interest in and to the Content available via the Service is the exclusive property of and owned by Your Key To Senior Living Options, our licensors or certain other third parties, and is protected by United States and international copyright, trademark, trade dress, patent or other intellectual property and unfair competition rights and laws to the fullest extent possible.
A limited, revocable, nontransferable license is granted to temporarily download one copy of the Service for personal, non-commercial transitory viewing only. This is not a transfer of title, right, or interest in the Service or Content. All content submitted by you to the Service may be retained by us indefinitely, even after you terminate your account. By submitting any User Content, you grant to Your Key To Senior Living Options a perpetual, worldwide, irrevocable, non-exclusive, royalty-free license to use the User Content in any manner, including to create derivative works, without any compensation or notice to you. Your User Content may be posted and transmitted to others at your own risk. We cannot control the actions of other users of the Service with whom you may choose to share your User Content.

Indemnification
Except to the extent prohibited under applicable law, you agree to indemnify, defend, and hold harmless Your Key To Senior Living Options and its officers, directors, employees, and agents from and against any and all claims, losses, liability, damages, costs, or expenses, including reasonable attorneys’ fees and costs, that may arise from or in connection with (a) your use of, or activities in connection with, the Service, including use of any service, good or product purchased through the Service, (b) violation of these Terms by you, or (c) your infringement of any intellectual property or other rights of any person or entity. If you fail to promptly indemnify and defend a covered claim, Your Key To Senior Living Options shall have the right to defend itself, and in such case, you shall promptly reimburse Your Key To Senior Living Options for all of its associated costs and expenses.

Governing Law
By accessing the Service, you agree that the laws of the United States and the state of Florida, without regard to conflicts of laws principles, will apply to all matters relating to the Service. You further agree that any litigation, action, or proceeding arising out of or related to these Terms shall be subject to the sole and exclusive jurisdiction of the state of Florida and that venue shall be in an appropriate state or federal court located in Orange County, Florida. You hereby submit to the jurisdiction and venue of said courts and consent to service of process by email in any legal proceeding.
Arbitration
Any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Florida before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
Class Action Waiver
You and Your Key To Senior Living Options agree that each party may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding. Notwithstanding any provision in the JAMS Comprehensive Arbitration Rules and Procedures to the contrary, the arbitrator shall not have the authority to hear the arbitration as a class, consolidated, representative, or private attorney general action or to consolidate, join, or otherwise combine any dispute, claim or controversy of different persons into one proceeding. Notwithstanding the arbitration provision set forth above, if the provision regarding waiver of class, collective, representative, and private attorney general claims is found to be void or otherwise unenforceable, any such class, collective, representative, or private attorney general claims must be heard and determined through an appropriate court proceeding in any court of competent jurisdiction in Florida, and not in arbitration.

These Terms and other Your Key To Senior Living Options policies cited herein constitute the entire agreement between you and Your Key To Senior Living Options and govern your use of the Service, superseding any prior agreements between you and Your Key To Senior Living Options relating to your use of the Service. You will be subject to additional terms and conditions when you purchase products or participate in a sweepstakes, contest, or other promotion. If any provision of these Terms is held to be invalid by any law, rule, order, or regulation of any government or by the final determination of any state or federal court, such invalidity shall not affect the enforceability of any other provision of the Terms.
